Judge to Decide on Upholding Trump’s Felony Conviction as Sentencing Nears Amid 2024 Election Drama
DEVELOPING—MAJOR: In just a few hours (this morning), Judge Juan Merchan will rule on whether to uphold Donald Trump’s felony conviction and set sentencing for September 18.
NOTE: In a letter released Tuesday, the Manhattan District Attorney's office opposed Trump's second attempt to delay his case after requesting it be moved to federal court.
NOTE: In a letter dated Friday but released Tuesday, prosecutors from District Attorney Alvin Bragg's office urged Judge Merchan not to delay his rulings. They noted, "The concerns the defendant expresses about timing are a function of his own strategic and dilatory litigation tactics."
NOTE: Prosecutors also stated they would leave the timing of the sentencing to the judge's discretion but argued that Merchan doesn't need to wait for a decision on moving Trump's case to federal court.
NOTE: On May 30, 2024, Donald Trump was convicted in New York on 34 felony counts for falsifying business records related to hush money payments to adult film actress Stormy Daniels during the 2016 campaign.
NOTE: The conviction made Trump the first former U.S. president to be found guilty of a felony and the first to run for president as a convicted felon.
NOTE: Trump and his allies argue that the various indictments and one conviction so far are politically motivated.
NOTE: If upheld, Trump’s sentencing would take place just eight days after his debate with Democrat Kamala Harris on September 10, coinciding with millions of voters beginning to cast ballots ahead of Election Day on November 5.
I don't see anything wrong in Trump requesting that the case be moved to a federal court even if that was his strategy to delay the sentencing. Strategy is a normal thing a'either from the perspective of the prosecutor or that of the defendant's.
Nobody should just have their way because they are whatever the are or seem to be and that includes both Bragg and Trump. Trump must not be denied justice by government because the government perceives him to be a political threat. In fact, to avoid a dangerous precedent, this matter should have been halted because it was ill timed there's no way people won't say Trump has been targeted because he's a political opponent.
I fear for America because I see a situation where somebody is going to retaliate what is going on. Somebody has mismanaged the situation and this put America is a very, very bad posture. I really wish we never got to this point.
